Pregnancy Discrimination in the Workplace
Pregnancy discrimination is something that many women experience in the workplace. Employers may begin to treat an employee differently (in an often negative manner) due to their pregnancy or planned childbirth. The fact is, this is a form of discrimination.
It is unlawful for an employer to discriminate against or terminate the employment of an employee based on their pregnancy. While unlawful, some employers do terminate pregnant employees or make their jobs unreasonably difficult. Some companies may not want to give an employee maternity leave even though it may be a part of their benefits package.
Common forms of pregnancy discrimination include:
Not being hired due to visible pregnancy or increased likelihood of becoming pregnant
At no point is it right for a manager to ask questions about a pregnancy. Medical information is protected.
Being fired after maternity leave
Mothers who have been out of the office are fired for a lack of production even if they were entitled to the leave.
Being fired after informing an employer of a pregnancy
Documentation of informing your employer is important as a paper trail is essential in some cases.
Receiving a reduction in pay or hours due to pregnancy
Watch for this happening slowly as a drastic cut in hours or pay can often immediately raise suspicion.
Being removed from job assignments, promotion, training, or access to benefits due to pregnancy
Some employers incorrectly believe that it is possible to effectively balance work and parenting.
Being denied disability leave or leave without pay due to pregnancy, if other employees are regularly granted that

Being prohibited from returning to work for a predetermined length of time after childbirth
You have the right to earn an income and return to the office after pregnancy.
Under federal law, employers are not allowed to discriminate against women because they:
Are pregnant
Were pregnant
Could become pregnant
Have a medical condition related to pregnancy; or
Have had or may be considering an abortion.
Pregnancy discrimination occurs when expectant women are fired, not hired, or otherwise discriminated against due to their pregnancy, intention to become pregnant, or childbirth.
