Wrongful termination is when an employee is terminated for any illegal reason
This includes:
Violations of federal or state anti-discrimination laws
Contractual breach
Legislation that states an employee cannot be fired based on his or her race, gender, ethnic background, disability, age, or religion.
It is also illegal to fire an employee because they lodged a legal complaint against their employer, or because the employee brought the employer’s wrongdoing to light as a whistleblower. Such adverse actions are considered retaliation and are unlawful. If you are treated differently after reporting something, you need to note this.
Some employers may give an employee unrealistic deadlines along with a huge workload in hopes of making them miss a deadline so they can be terminated.
Employment in most American states is considered “at-will”, and therefore not guaranteed. This means your employer is free to terminate your employment at any time. Termination can be for any reason or no particular reason at all. The exception is when an employee is fired for illegal reasons (such as discrimination or retaliation) or in violation of an employment contract.
If you can prove that your termination was prompted by racial intolerance or a culture of sexism, for instance, then you might have a claim for wrongful termination.
If your termination cites lack of productivity, yet you were performing at a reasonable level and/or doing better than a peer, documents shared via email that include productivity numbers might be considered evidence and could indicate discrimination.
If you signed a contract that outlined your duties, responsibilities, and benefits of your employment, then the employer must honor these terms. If your contract states that you may be fired only for failing to meet certain benchmarks or criteria or suggests a certain level of job security, this could mean that your job is not considered “at-will”.
